Is emailing a client illegal?

Posted by craig on January 15, 2012

Communication with clients is critical to building strong relationships and email is a cost effective way to do this. Most business owners I call on say "I have a database" however what they don't realise is these types of databases i.e held through an accounting package and gained without the persons consent to receive emails can not be used legally. All it takes is one spam complaint from a client who has forgotten who you are, or no longer likes you or your business and you have a major problem on your hands filled with red tape and bureaucrats. Arggghhhhhhhhh!!

The rules and regulations about unsolicited email in New Zealand are very clear as are the laws in the USA.

You cannot send an unsolicited email to anybody without their permission. Fines can be up to 150,000$

Building a client database using the legal model (our system) makes any business doing email marketing effectively water tight when it comes to spam complaints. Plus it gives you peace of mind that the people receiving your email actually want to hear from you.

And believe it or not there is still a truckload of business done by email marketing.
